These Terms & Conditions govern all quotations, bookings, and services provided by JVK Shipping Services LLC (“JVK”, “we”, “our”, “us”). By accepting our quotation or using our services, the customer (“you”, “your”) agrees to be bound by the following terms.
1.1. All rates are valid for 7 days from the date of quotation unless otherwise specified in writing.
1.2. Rates are subject to space, equipment, and tonnage availability at the time of booking.
1.3. Rates may change due to carrier revisions, fuel surcharges, currency fluctuations, or regulatory changes.
2.1. Quoted charges cover only the services expressly mentioned in the quotation.
2.2. Any additional services or costs such as storage, detention, demurrage, inspections, customs fines, penalties, re‑handling, or other unforeseen charges will be billed separately at actuals.
Unless specifically stated otherwise, quotations exclude: – Customs duties, VAT, exercise, or any government taxes or levies – Cargo insurance – Charges arising from misdeclaration, incorrect documentation, improper packing, or hazardous cargo
5.1. Cargo must be properly packed, labelled, and accompanied by complete and accurate shipping documents.
5.2. Dangerous Goods (DG) / Hazardous Cargo must be declared in advance with all required approvals and documentation in compliance with IATA / IMO regulations.
5.3. JVK reserves the right to refuse cargo that is unsafe, improperly declared, or non‑compliant.
6.1. Transit times are estimated only and subject to carrier schedules, customs clearance, port congestion, and force majeure events.
6.2. JVK shall not be liable for delays beyond its reasonable control.
7.1. JVK acts as an agent only for airlines, shipping lines, trucking companies, couriers, and other service providers.
7.2. Liability is limited to the extent provided under applicable international conventions, including but not limited to the Warsaw Convention, the Montreal Convention, the Hague‑Visby Rules, and CMR.
7.3. Any claims must be notified in writing within 7 days from the date of cargo delivery or availability.
8.1. Cargo insurance is not included in the quotation.
8.2. Insurance can be arranged upon written request and subject to payment of the applicable premium.
9.1. All charges are payable in advance unless written credit terms are approved by JVK.
9.2. Payments must be made without deduction, set‑off, or counterclaim.
9.3. Delayed payments may attract late payment interest and/or suspension of services.
10.1. Customs clearance charges are based on normal processing procedures.
10.2. Any additional inspections, fines, penalties, or delays imposed by customs or government authorities will be charged at actuals.
10.3. The customer is responsible for the accuracy of declarations and documents submitted.
11.1. Rates are based on normal business hours unless otherwise agreed.
11.2. Additional charges apply for after‑hours, weekends, or public holidays.
11.3. Waiting time beyond the free period will be charged additionally.
JVK shall not be liable for any loss, damage, delay, or failure to perform caused by events beyond its control, including but not limited to natural disasters, strikes, war, port congestion, carrier disruption, or regulatory changes.
13.1 Air Import & Air Export
13.1.1 Freight Basis
All air freight charges are calculated based on chargeable weight as per IATA rules, using the higher of actual gross weight or volumetric weight (1 CBM = 167 Kgs).
13.1.2 Cargo Declaration
Dangerous Goods (DG), perishables, temperature-controlled cargo, lithium batteries, or special cargo must be declared in advance with full documentation including MSDS, DG Declaration, and approvals. Misdeclaration may result in rejection, delays, or penalties at shipper’s or consignee’s cost.
13.1.3 Transit Time
Transit times are indicative only and subject to airline schedules, customs clearance, and security checks. JVK Shipping Services LLC shall not be liable for delays beyond its control.
13.1.4 Exclusions
Air freight quotations exclude customs duties, VAT, destination charges, and airline surcharges unless stated otherwise.
13.1.5 Liability
JVK Shipping Services LLC acts as an agent for airlines and liability is limited under the Montreal and Warsaw Conventions.
13.2 Sea Import & Sea Export (Dubai, UAE)
13.2.1 Freight Basis
FCL shipments are charged based on container size and type.
LCL shipments are charged on CBM or 1000 Kgs, whichever is higher.
13.2.2 Demurrage & Detention
Free time is strictly as per shipping line policy. Any demurrage or detention charges due to delays in clearance or documentation shall be payable by the customer.
13.2.3 Port & Terminal Charges
Terminal handling charges, port storage, delivery order charges, and port authority fees are excluded unless specifically mentioned.
13.2.4 Documentation & Compliance
Customers are responsible for accurate and timely documentation. UAE customs and port regulations apply. Any penalties due to non-compliance will be charged at actuals.
13.3 Courier Services
13.3.1 Chargeable Weight
Courier shipments are charged based on actual or volumetric weight, whichever is higher (5000 cm³ = 1 Kg).
13.3.2 Prohibited Items
Restricted items including currency, precious metals, weapons, hazardous goods, or prohibited items under UAE or destination law are not accepted.
13.3.3 Duties & Taxes
All customs duties, VAT, and destination taxes are payable by the consignee unless agreed otherwise.
13.3.4 Liability
Courier shipments are subject to carrier terms with limited liability. Insurance is recommended.
13.4 Land Transport
13.4.1 Freight Basis
Charges are based on truck type, route, weight, or volume.
13.4.2 Transit Time
Transit times depend on traffic, border clearance, and security conditions.
13.4.3 Oversized / Overweight Cargo
Such cargo requires advance approval and may incur additional charges.
13.4.4 Waiting & Detention
Waiting time beyond free hours will be charged additionally.
13.5 Cross Trade (Air & Sea)
13.5.1 Scope
Cross-trade shipments involve movement between two countries where UAE is neither origin nor destination. JVK acts strictly as a forwarding agent.
13.5.2 Charges
Local charges at POL and POD are excluded unless stated.
13.5.3 Documentation Responsibility
Shippers are responsible for accurate documentation. Delays or penalties due to errors shall be borne by the customer.
13.5.4 Confidentiality
JVK Shipping Services LLC maintains confidentiality of shippers and consignee information except where disclosure is required by law.
14.1. All quotations, services, and transactions are governed by the laws of the United Arab Emirates.
14.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of the UAE.
15.1. By accessing, using, booking, or confirming any service through JVK Shipping Services LLC’s website, ERP, CRM, customer portal, email, or any digital platform, the customer expressly acknowledges that they have read, understood, and agreed to these Terms & Conditions.
15.2. Where services are booked through an online system or software platform, acceptance of these Terms & Conditions shall be deemed valid and binding upon: – Clicking an “I Agree”, “Accept”, or similar confirmation button; or – Submission of a booking, quotation acceptance, or service request electronically; or – Continued use of JVK’s systems or services after being presented with these Terms & Conditions.
15.3. Electronic acceptance shall constitute a legally binding agreement, enforceable in the same manner as a physical signature, in accordance with applicable UAE laws and electronic transaction regulations.
These Terms & Conditions form an integral part of all quotations, invoices, contracts, and service documents issued under the official branding of JVK Shipping Services LLC.
All official documents may carry JVK’s corporate letterhead, logo, color scheme, and digital watermark and shall be considered valid whether issued in physical or electronic form.
